Convention on the Rights of Persons with Disa

Let me allow to furnish the information regarding the ratification of the United Nations Convention on the Rights of Persons with Disability(UNCRPD). The Government of Nepal, Ministry of Women, Children and Social Welfare has already submitted the disolution for the ratification of UNCRPD and its Optional Protocol in the Legislative-Parliament. Any further information required in this regard is highly appreciated.

HR Action Plan

Pranita jee Either you misunderstood my way of communication or i was poor to communicate you in this matter. What I wanted to communicate all the concern is that the current HR action plan was laready approved by the government on 2064-6-13 therefore I said there is no use of the consultation at present for the already approved action plan. The approved action plan was in Nepali version but translation of the same in english is not yet done. Consultations with stake bearers makes any sense for just to translate Nepali version to english. However, consultation is required to implement it. Further, I believe that new round of consultations with all the stake bearers will be required to prepare new action plan in the future. If you need more clarification pls feel free to tell me

Dear Secretary, First of all thanks for the clarification. I agree that consultation during 'translation' of the document is not necessary. Whereas i still believe that depriving stakeholders in the process of policy was wrong move of the government. I believe public participation will get some recognition in coming days. This time i wanted to talk about the United Nations Convention on the Rights of Persons with Disability(UNCRPD). Nepal has signed the convention and its protocol on 3rd of January 2008. Would you please let we people know what the Nepal government is doing for the ratification of this convention. Similarly, i came know that Nepal is developing its first-ever mental-disability policy. Its a problem in our country that we sign convention but do very little to implement those. As Nepal has already signed this convention and sooner or later going to ratify it, then it will be its obligation to follow the standards provided by the convention. In the regard, now it is an opportunity for us that we can include the principles and standards prescribed by convention in upcoming Mental-heath policy and mental-health law. From the office of Prime Minister could you please follow up these issues (probably its being done from Ministry of health) and notify us about ratification of convention and current status of MH policy and Law. Dear Secretary, I am really disappointed to know that your office has come up with HR action plan without consultation with stakeholders and other constitutional bodies such as National Human Rights Commission. Even if you say there was consultation, i couldnt read anything in the preface of the action plan. I am quoting one of the para from the action plan. मानव अधिकार राष्ट्रिय कार्ययोजनामा उल्लिखित कार्यक्रमहरु एउटा निकाय विशेषको मात्र जिम्मेवारी भित्र रहने कार्यक्रम नभई यो विभिन्न केन्द्रीय तथा स्थानीय सरकारी निकाय राष्ट्रिय तथा अन्तर्राष्ट्रिय गैरसरकारी संस्था द्विपक्षीय तथा बहुपक्षीय दातृ निकाय एवं नेपाल सरकारको नीति तथा कार्यक्रमको सहयोगको लागि कार्य गर्ने विकास सहयोगीहरुको पनि जिम्मेवारी हो । So, you want to share the responsibility but you dont want them to be part of the process. How can an amicable relation between stakeholders can flourish, when the government even dont want them to know what it is doing? And at the same time i would like to know the date when this action plan was approved by the Nepal Government, and which authority? Cabinet Ministry? Pranita

Dear Secretary, Its been long time since i last visited your blog and some of the government websites. In my last post i had put my query about the HR action plan. Today i was visiting OPMCM and came to know that the document is being updated. I hope its true and the ministry is really serious about it. I have some concern regarding the process the ministry has adopted on this. I am not sure if the ministry has publicized or notified the general public or other stakeholder regarding the update or on new HR action plan. Public participation in policy making and Procedural Transparency is important features of the democratic government/governance. As the HR action plan will be a guiding principles for executive branches as well as for government programs later it is very necessary that the process include other government agencies such as National planning commission and NGO sector. Similarly, before adopting that action plan it is a right of the people to express their comment/concerns on that paper, so that you can accomodate their concerns also. I would really have praised if you had put in the website a simple notice that the government is coming up with New HR action plan and requested suggestion from the citizens and other stakeholders. Similarly, a notice in daily newspaper would have reached a wider public. Public participation in policymaking is not only a dry slogan but has to see the reality of the day and i suppose an honest effort from the side of the government make it possible. I was re-reading your response in the blog. And i really dont like your tone when you said 'There is no use of conducting public consultation in this matter'. I cant believe that a responsible government official is saying that there is NO NEED of public participation in the formulation of HR action plan. Absurd !!

Dear Mr. 123 I am unable to post your second text. You have used very rough words accusing personally. However I will try to answer you in the following paragraph. 1. I definitely remember what I did as account officer and doing as secretary. I suggest you be specific what you wanted to tell by that statement. Why you are so abusive of the some initiatives we have taken in OPMCM? Is there anything that hurt you or any Nepali by this? I have never claimed I am smarter and said never made propoganda like I did this and I did that. if you tag on me by this or by that that is the problem of your understanding. Yes I am transferred twice in past one and half year time. May I request you to consult my bosses and post their assessments of my level of performance and make it publicly in this blog so that I will have an opportunity to identify my areas of weaknesses and correct myself? I have worked with more than two dozen Ministers directly or indirectly but with close contact. That will give a sufficiently real picture. Let me allow responding your specific questions one my one. First about my recommendations as the best employee: When I was recommended as the best employee of the year from a ministry my first comment was “I am happy that I got it but many more who have contributed more than what I did may have left over in far-flung of Nepal”. I still have that sentiment therefore I personally will try my level the best to recognize the best performers. The OPMCM will start a mechanism to recognize those employees who have initiated best practices. I tried my level the best to improve service delivery mechanism in corruption free manner in the department of cottage and small industry. The ministry may have recognized that initiative and had awarded me as the best employee. 2. You have commented about my position in Lhasa. Whatever adjective you want to use for my position it is up to you. No comment. But I never recommended downgrading the level of consul general as you have mentioned. I have recommended that Joint Secretary from the ministry of foreign affairs may be more appropriate than JS from other ministries who have to learn a lot about diplomacy before starting core job. I had submitted more than 35 reports during my 45 months duration. I suggest you to go through those reports before making any comments. Your third question was about my property: I have invested almost 39 lakhs to build my home including the cost of land. I have legal income more than the double of that investof ment during last 10 years time. That does not mean that I have still huge bank balance. No not, absolutely not. 3. Why you are so angry with toll free number? We will monitor the outcome of complains that we already started and we will make the report public every month. If we fail to realise the objective then you can suggest us to close it. I request all those who read it to cooperate us to change the face of Nepalese bureaucracy rather than playing a blame game. Is there anything wrong if we provide you an opportunity to make phone call free of charge and register the complain? If you are also in the government service (I guess so based on your comments) can’t you do something worth to your organization rather than accusing others who are honestly trying to do something for the service of the people? This space is for constructive discourse not to abuse others taking advantage of keeping your identity anonymous. 4. You have given even fake email. Why you are so scary of writing true email even. I can’t and will never try to, trace you even if you give true email.

if it is only for registering the suggestions and complaints which ultimately will be forwarded to the concerned agencies what is its use as such mechanism is already in place in each institution. if it is merely for gaining cheap popularity by showing yourself an innovative high level government official then congratulations for that. how can you prove that you can take actions on such issues? can you give us feedback with the actions taken or simply escape by saying the issue has already been forwarded to somewhere else? though the step sounds good but the nepali people do not want only the steps they want the result, can you give us one example which is handled and got to the conclusion using this mechanism?

OPMCM has introduced electronic processing of visitor's gate pass from Baisakh first on trial basis. Similarly toll free number 1111 is fixed to receive complains from anypart of Nepal. You all are requested to give us feed back of both the facilities so that we can expand this service to other offices too. leela

Dear Secretary, Bravo !! For new steps. Can any policy guideline or directive be issued from any concerned agency (OPMCM might be the appropriate one) for government offices (at least in ministry and departments level in the beginning, if not for all) to assign somebody (responsible person) for the email communication. We are talking about e-governance and transparency and have invested a lot of resources for the infrastructure. However, utilization of such mechanisms is in very low level. A policy directive from your office might turn the trigger to boost the performance level of email communication in government offices. Hope to hear your comments. Pranita

National Human Rights Action Plan

Dear Secretary, Lets also talk today about something else than communication system and website. I know we have limited resources and government alone cannot keep eyes on everything. Thats why you asked for the suggestion and me, as a responsible citizen is always there to tell you what i feel and know. The website of OPMCM has a National Human Rights Action Plan in its website, which is issued in 2004 by then HMG. The action plan was for 3 years. In between political regime, system and government everything has changed. However, the outdated action plan is still in the website of the government. I am not only concerned why the document is there but i am concerned whether the government is considering anything to bring any new human rights action plan or not. Any such HR action plan, compatible with the international convetions ratified by Nepal and with Interim constitution will be a guideline for all branches of executive to move forward. Dear Secretary, I was visiting your page and realized that you are updating the homepage of your website. As you are doing some editing in your website, i thought it would be not bad to suggest you something at this point. Privacy is one of the fundamental rights protected by the interim constitution of Nepal. A person in communication with you must have the right to determine whether he wants her address is published or not. It is also part of the 'netiquette', that you ask your visitor if they want to publish their email address or not?? you have made the email filed mandatory in this comment post, however it is appropriate if you put one more field and ask them whether they want to publish their email address or not. Prakash and Pranita jee Interactive blog is a personal site that I can't impose on my successor by creating it in official portal. My successor may not be ready to face this challenge or would just think that it is a worthless time pass. However, a common platform to discuss organizational issues would be a good start. I will try to create such forum in my new place but will continue this blog where ever I go. I would like to thank all the users of this blog particularly those who have posted critical comments that helped me to understand the problem from others eyes or dimensions. I hope you will keep your eyes on me so that I will always in pressure not to indulge in wrong thing or to do things correctly. I will never be disappointed with the critical comments on my performance however I feel sorry to those who involve in personal accusation and baseless blame misusing the platform created with earnest honesty taking advantage of keeping them in disguise.
